309 & 100 (Offshore Partner) Visa 
The Partner Visas (Subclasses 309 and 100) provide an avenue for the spouse or partner of an eligible New Zealander, an Australian permanent resident, or an Australian citizen to live in Australia.

Subclass 309 (Partner (Provisional) Visa):

The Subclass 309 visa is a temporary visa that enables the de facto partner or spouse of an Australian national, Australian permanent resident, or eligible New Zealand national to reside temporarily in Australia. It serves as the initial step towards obtaining the permanent Partner visa (subclass 100).

Features:

  • This is a temporary visa.
  • Subclass 309 leads directly to the permanent Partner visa (subclass 100).
  • You must be outside Australia when applying for this visa.
  • During the processing of your permanent Partner visa (subclass 100) application or until you withdraw it, you can stay temporarily in Australia.

Eligibility:

  • You must be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident, or eligible New Zealand citizen.
  • Your spouse or de facto partner must sponsor you.
  • Both you and your family members applying with you must be outside Australia when applying for this visa.

Subclass 100 (Partner (Migrant) Visa):

The Subclass 100 visa is a permanent visa that enables the spouse or de facto partner of an eligible New Zealand citizen, Australian permanent resident, or Australian citizen to live permanently in Australia. Typically, this visa is available for those who hold a temporary Partner visa (subclass 309).

  • This is a permanent visa.
  • You must already possess a temporary Partner visa (subclass 309).
  • With the Subclass 100 visa, you can reside permanently in Australia.

Eligibility:

  • You must be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident, or eligible New Zealand citizen.
